									Providing employee feedback is an important part of the employment relationship and supports your employee to do their best to thrive in their role. Providing negative feedback is never easy.

<p>Tips to navigate negative feedback conversations:<br></P>

<p> <strong>Address issues promptly. </strong>Providing timely feedback ensures it is relevant and actionable, helping employees address issues promptly and prevent performance concerns from recurring or escalating.</P>

<p> <strong>Use face to face communication. </strong> Be personable and genuine. Face to face feedback supports the relationship between yourself and the employee and the feedback being provided is less likely to become misconstrued. Avoid any miscommunication. <br>

<p> <strong> Avoid prejudgement. </strong> Be open to the employee. Be prepared to listen &#8211; not just talk. It is ok to have a plan for the conversation but allow the conversation to occur and be open to the employee response before reaching any conclusions.</P>

									<p> <strong>Ensure the conversation starts on a positive note.</strong> Starting a conversation positively can support the employee engagement in the conversation and enable the employee to better receive the information.</p> <br>

<p> <strong>Be respectful.</strong> Ensure that the delivery of feedback is done in a way that is respectful, professional, considered, and always constructive. </P>

<p> <strong>Acknowledge your employee’s strengths. </strong>Recognising and balancing both strengths and areas for improvement ensures that employees receive acknowledgment for their efforts and achievements, not just feedback on where they need to improve. </P> <br>

<p> <strong>Encourage reflection. </strong> Ask your employee reflective questions and provide the employee time to reflect and respond to the feedback. Engage in conversation with them about their performance and any contributing actions and ways in which they can improve. </P>

<p> <strong>Build trust.</strong> Ensure that these discussions are always held privately and done in a confidential manner. An employee is likely to develop trust where this is prioritised and fostered. An employee who feels safe and has trust in the employment relationship is more likely to receive negative feedback well and use the feedback constructively.

Instead, performance management is about employees feeling and being supported in removing barriers to success, acknowledging their strengths, and clearly identifying future goals.</p> 

<p><strong>Fact:</strong> The key relationship is between the employee and employer and the style of the performance management discussion. The discussion should be a safe place for the employee to reflect on strengths and development areas and plan for growth.</P>                         </div>

<P><strong>Fact:</strong> An employee who feels well supported is more likely to be a willing participant in the performance management process. A support person can make an employee feel safe in an environment that may otherwise cause them angst.</P>                         </div>

                            <P><strong>False!</strong> A position description outlines the position requirements which includes related tasks and any duties required to be fulfilled. For this reason, the position description is a great resource in referencing the focus points of a performance improvement plan or highlighting key performance indicators. The performance improvement plan and any performance review should focus directly on the key outcomes that are imperative to the success of the role. Focusing on too much at once can be overwhelming and lead to further performance issues. Performance improvement plans need to be clear, concise, reasonable, and achievable. </P> 

<P><strong>Fact:</strong> Key areas for improvement should be linked to a training or development plan which is often set out as part of the performance review or performance improvement plan and sets out how the employee will be supported and enabled to meet the performance expectations and make meaningful improvements.</P> 

<P>Where an employee is not meeting the expectation of performance in the role an improvement plan focuses on the underperformance in key areas with specific time frames for measuring and monitoring the employees, growth and improvement in those key areas and identify any ongoing gaps. The performance should be regularly reviewed, and a performance improvement plan should include the dates of all reviews.</P>                         </div>

                            <P>Ideally you and your employee can agree on a supportive pathway to improvement. However, sometimes an agreement can be tricky. Emotion can often lead to a difference in opinion, which is okay and can be recorded. </P> 

<P>Clients often report not receiving a “signed” returned document from an employee and feel restrained by the lack of agreement or engagement. Although agreement is the ideal, a lack of agreement need not delay progress.</P> 

<P><strong>Fact:</strong> As the employer, you set the standard of work and the expectations of performance.</P> 

<P>If the expected quality and work performance is reasonable and within an employee's range of skills and the role requirements, as the employer you can direct the employee to work towards an expected level of output and performance. One of those expectations can also include the employee participation in the workplace and engagement in the performance improvement and or performance management process.</P>                         </div>

									<p>Without regular social interactions between colleagues there is a reduced opportunity to demonstrate and support aspects of the employment relationship including psychological safety, competence, consistency, dependability, and integrity. A hybrid work model though presenting a reduction in physical and face to face contacts can be supported through virtual face to face contact such as the use of online platforms (such as teams and zoom amongst others) to have virtual conversations as an alternative to a telephone conversation. Every employee should have regular ongoing support in the remote workplace just as they would onsite surrounded by their colleagues.</p>

<p>A lack of in person contact, social interaction, and communication, can lead to mistakes, mis-intent, or misunderstandings due to loss of social cues. It is more important for this reason that there are increased regular interactions and communication to ensure an employee is engaged and feels connected to the team.  </P>								</div>

									<p>With social workplace bonds changing, The State of the Global Workplace report found that 67 percent of Australian and New Zealander’s surveyed were emotionally detached from their employment. Eleven per cent of those were reported as “loud quitting”, that they were actively disengaged, demonstrating a breakdown in trust between employees and their Employer.</p>
<p>Many employees seek the positives provided by a hybrid or remote working arrangement including flexibility of the home-office location, and the genuine work life balance that working remotely (or in a hybrid manner) offers. For this reason, employers are considering new ways to overcome the challenges of the remote work environment and the constraints associated with that to enable and best support such ways of working, ongoing.</p>
<p>Where there are little or no social cues, systems still remain imperative including more formalised structures, processes and metrics which can be implemented and maintained (and monitored) to support employees in forming and maintain trust in their workplace relationships. </p>								</div>

<p>This type of framework involves clear, concise, constructive, and regular communication between members of remote and hybrid working teams. This includes explanation of the workplace challenges and defining the shared responsibility for positive workplace outcomes and maintenance of healthy workplace interactions. </p>								</div>

<p>Employee engagement represents the levels of enthusiasm and connection employees have with their employment. It&#8217;s a simple measure of how motivated people are to put in extra effort for their organisation and a sign of how committed they are to staying there. Employee engagement depends on the actions of their organisation, driven by leadership, managers, and people teams.</p>
<p>Collecting feedback to measure employee engagement at a scale empowers you with the data of your employees’ voice and provides you the opportunity to improve the employee experience, building your business reputation and strengthening your workplace culture.</p>
<p>Using the data collected you can understand the areas for improvement, analyse gaps and learn more about your teams’ motivation, including why employees stay and/or why they choose to leave.</p>
<p>A good survey is the key to obtaining feedback with the right data and insight. The following points will help you get the most out of your employee engagement surveys.</p>
<ul>
<li>Ensure the survey is effectively communicated to your employees. What is the survey, when will the survey be conducted, how is the survey completed and why are you doing an engagement survey?</li>
<li>Ensure the survey itself is brief, clear and engaging to get the most out of your employee responses.</li>
<li>Ask the questions that you would like the answers to but consider those you are prepared to take on board and action. Employees anticipate that their participation will amount to a valuable workplace contribution and expect to see changes or other outcomes in the future.</li>
<li>Include open ended and free text questions as a way to capture anything that hasn’t specifically been asked.</li>
<li>Ensure your workplace leaders are up to speed and that they get on board with the employee engagement survey by speaking with employees and encouraging participation.</li>
<li>Run your survey regularly so that you can compare the level of employee engagement and the business improvement and growth from one period to the next.</li>

<p class="MsoNormal" style="margin: 13.5pt 0cm; line-height: 15pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The minimum employment period operates to provide an employer with an opportunity to terminate the employment of an employee during the applicable period without risking the<br>
potential consequences of an unfair dismissal claim.&nbsp;However, once an employee has completed the applicable minimum qualifying period of 6 or 12 months, they will receive full protections and will have the right to make an unfair dismissal claim should their employment be terminated.&nbsp;&nbsp;As<br>
such, once the minimum employment period has been completed, it will be essential that an employer follow a fair and reasonable dismissal process and have a genuine, justifiable reason prior to termination of employment occurring.<o:p></o:p></span></p>
<p class="MsoNormal" style="margin-top:6.0pt"><strong><span style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">Probationary Periods<o:p></o:p></span></strong></p>
<p class="MsoNormal" style="margin: 13.5pt 0cm; line-height: 15pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">In comparison, Probationary periods are a contractual provision that are detailed in an employment agreement. Probationary periods are not provided for or prescribed by the Fair Work Act 2009.<o:p></o:p></span></p>
<p class="MsoNormal" style="margin: 13.5pt 0cm; line-height: 15pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">A probationary period is intended to allow both the employer and the employee with the opportunity to assess each other, and the role.&nbsp; In circumstances where it is determined that an employee is not suited to a particular position or the business, termination of employment within the probationary period may occur.<o:p></o:p></span></p>
<p class="MsoNormal" style="margin: 13.5pt 0cm; line-height: 15pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">Probationary periods are commonly set for a shorter period than the minimum employment period, for example 3 months. Where provided for in the employment contract, the probationary period may be extended for a further period in circumstances where an employer requires more time to assess the suitability of the employee.<o:p></o:p></span></p>
<p class="MsoNormal" style="margin: 13.5pt 0cm; line-height: 15pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">However, if the probationary period length was to exceed:<o:p></o:p></span></p>

<p class="MsoNormal" style="margin: 13.5pt 0cm; line-height: 15pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">the application of the probationary period would not be enforceable, and no advantage would be</span><span lang="EN-US" style="mso-ascii-font-family:Calibri;mso-ascii-theme-font:minor-latin; mso-hansi-font-family:Calibri;mso-hansi-theme-font:minor-latin;mso-bidi-font-family: Calibri;mso-bidi-theme-font:minor-latin;color:black"> </span><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">provided to the employer as the employee would receive the benefit of unfair dismissal protections. <o:p></o:p></span></p>
<p class="MsoNormal" style="margin: 13.5pt 0cm; line-height: 15pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">Probationary periods set out in a common law employment contract cannot override the provisions of the Fair Work Act 2009 and both periods operate independently.&nbsp; As such, the minimum employment period will override the probationary period, for example, if an employee has passed their three-month probation, but are subsequently dismissed after five months employment, they&nbsp;would not qualify for&nbsp;unfair dismissal</span><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat;">&nbsp;protections.<span style="background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><o:p></o:p></span></span></p>
<p class="MsoNormal" style="margin: 13.5pt 0cm; line-height: 15pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">To maximise the effectiveness of a probationary period, it is recommended that employers set their probationary periods to be for a shorter period than the applicable minimum employment period. Doing so will enable the employer to ensure that an assessment is undertaken of the employee’s performance and suitability for the role prior to the qualifying period having been completed.<o:p></o:p></span></p>
<p class="MsoNormal" style="margin: 13.5pt 0cm; line-height: 15pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">We further recommend that employers:<o:p></o:p></span></p>

<p class="MsoNormal" style="margin: 13.5pt 0cm; line-height: 15pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">It is important to note that while unfair dismissal provisions will not apply to an employee during the minimum employment period, the employee will still be entitled to general protection provisions. An employee who is dismissed prior to having completed their minimum employment period are not prevented from bringing an “adverse action” claim against an employer under the Fair Work Act 2009 should their termination result from a discriminatory matter.&nbsp; Care must be taken by an employer to ensure that the reason for the termination is not a prohibited or discriminatory reason so as to minimise of such a claim. <o:p></o:p></span></p>

Such meetings where a support person may be present include performance, disciplinary, and termination meetings, as well as meetings held in relation to a workplace investigation (this includes where the employee is being interviewed in the capacity of being a witness).</span><br></p>
<p class="MsoNormal" style="margin: 13.5pt 0cm; line-height: 15pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">Although the&nbsp;Fair Work Act&nbsp;2009 does not specifically state that an employer is required to offer the employee the opportunity to bring a support person to a meeting, an employer cannot unreasonably deny an employee’s request to do so.&nbsp;In order to reduce any potential procedural delays or disputes regarding procedural fairness, we recommend that an employee be advised that they may have a support person in attendance at the time of being invited to attend a formal meeting. </span></p>

<p class="MsoNormal" style="margin: 13.5pt 0cm; line-height: 15pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">A support person can be a person of the employee’s choosing, and could be anyone from a colleague, union representative, a lawyer, friend or family member. &nbsp;The role of the support person is to provide moral and emotional support for the employee only. The support person is not there to answer questions or to speak on behalf of the employee. Similarly, they cannot engage with or disrupt the meeting. The support person may however offer advice to the employee throughout the meeting and take notes.</span></p>

<p class="MsoNormal" style="margin: 13.5pt 0cm; line-height: 15pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">As an employer, while you may request that the employee inform you who it is they intend to use as their support person, there are only limited instances in which the chosen support person can be vetoed, such as where there will be a conflict of interest (for example, where the nominated support person will be involved in the investigation process in any capacity, such as a potential witness).</span></p>
<p class="MsoNormal" style="line-height: normal; margin: 6.0pt 0cm 0cm 0cm;"><strong><span style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">What if the support person becomes disruptive?</span></strong></p>
<p class="MsoNormal" style="margin: 13.5pt 0cm; line-height: 15pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">To minimise the likelihood of a support person trying to intervene in the meeting or overstep their role, it is recommended that steps be taken to inform and/or remind the support person of what their role is and what the boundaries are at the commencement of each meeting. The employee should also be reminded that they can request to speak with their support person privately if required during the meeting. </span></p>
<p class="MsoNormal" style="margin: 13.5pt 0cm; line-height: 15pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">In addition to notifying a support person of what their role is in the meeting, it is essential that they are also made aware of what confidentiality restrictions they are bound by. Where the support person is also an employee, they should be advised that any confidentiality breaches could result in disciplinary action, up to and<br>including termination.&nbsp; </span></p>
<p class="MsoNormal" style="margin: 13.5pt 0cm; line-height: 15pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">In the event that the employee’s support person does not comply, or they repeatedly overstep their role, the employer should take steps to again remind them of what their role is. If required, the meeting can be ceased until such time that the support person agrees to comply. </span></p>
<p class="MsoNormal" style="margin: 13.5pt 0cm; line-height: 15pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 13.5pt; font-family: Montserrat; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">If the support person’s conduct does continue, there may be a requirement to speak with the employee to request that they reconsider who they bring with them as a support person going forward. </span></p>
